These Terms of Service (“Terms”) govern your access to and use of Lakestone.ca, including all related content, features, digital products, physical merchandise, tools, and services (collectively, the “Services”).

Lakestone Vodka (“Lakestone”, “we”, “us”, “our”) operates the Services.

By accessing or using the Services, you agree to be legally bound by these Terms, our Privacy Policy, Cookie Policy, Return & Refund Policy, and Shipping Policy.

If you do not agree, you must not access or use the Services.

1. Age restriction and eligibility

The Services contain branding and cultural content relating to alcoholic beverages.

Access is strictly limited to individuals of legal drinking age in their jurisdiction (18+ in Manitoba).

Access to the Site is subject to a mandatory Age Gate verification mechanism.

By entering the Site, you represent and warrant that:

  • You are of legal drinking age in your jurisdiction;

  • You are legally permitted to access alcohol-related content;

  • You will not allow minors to access the Services through your device or account.

Lakestone reserves the right to restrict or terminate access where age verification is falsified or circumvented.

2. Important notice – no online alcohol sales

Lakestone does not sell alcoholic beverages through this website.

Any references to vodka or alcoholic products are for informational, branding, educational, or cultural purposes only.

Alcoholic products associated with Lakestone are distributed exclusively through authorized provincial retailers, including Manitoba Liquor & Lotteries (MBLL), in accordance with applicable law.

Nothing on this Site constitutes an offer to sell alcoholic beverages directly to consumers.

3. Nature of products and services

Lakestone may offer:

  • Digital products (including ebooks, guides, and online-access materials);

  • Physical merchandise produced on demand and fulfilled by third-party partners such as Printful.

All product descriptions, pricing, availability, and specifications are subject to change without notice.

We reserve the right to refuse or cancel orders at our sole discretion.

4. Digital products – license and use restrictions

Upon purchase and/or download of a digital product, Lakestone grants you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only.

You may not:

  • Reproduce, distribute, resell, sublicense, or share digital products;

  • Upload digital products to file-sharing platforms;

  • Modify or create derivative works for commercial purposes;

  • Remove copyright or proprietary notices;

  • Circumvent digital access controls.

Unauthorized use constitutes a material breach of these Terms and may result in:

  • Immediate termination of access;

  • Legal action;

  • Recovery of damages to the fullest extent permitted by law.

All intellectual property rights remain the exclusive property of Lakestone.

5. Digital products – final sale & waiver

Digital products are delivered electronically.

By completing a purchase, you acknowledge and agree that:

  • Delivery or access may begin immediately after payment confirmation;

  • You waive any right of cancellation once delivery/access has commenced, to the fullest extent permitted by applicable law;

  • All digital sales are final and non-refundable, except where required by law.

Lakestone is not responsible for failure to download or access digital products due to user device compatibility issues.

6. Physical products – print-on-demand

Physical merchandise is produced on demand and fulfilled by third-party providers, including Printful.

Production and shipping timelines are estimates only.

Lakestone is not responsible for delays caused by fulfillment partners, shipping carriers, customs authorities, or events beyond our reasonable control.

Risk of loss transfers to the customer upon confirmed delivery by the carrier.

Returns and replacements are governed exclusively by our Return & Refund Policy.

7. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

  • Provide accurate information;

  • Notify us immediately of unauthorized access;

  • Accept responsibility for activities conducted under your account.

Lakestone shall not be liable for losses arising from unauthorized access due to user negligence.

8. Pricing and payment

All prices are listed in Canadian dollars unless otherwise stated.

Applicable taxes and shipping fees will be calculated at checkout.

Payments are processed securely through Shopify and authorized payment providers.

Lakestone does not store full payment card numbers.

We reserve the right to correct pricing errors and cancel affected orders.

9. Prohibited uses

You agree not to use the Services:

  • For unlawful purposes;

  • To violate intellectual property rights;

  • To engage in fraudulent activity;

  • To interfere with security or functionality;

  • To scrape, copy, or exploit content without authorization;

  • To attempt to bypass the Age Gate.

Violation may result in suspension or termination.

10. Intellectual property

All content on the Services, including but not limited to:

  • Logos

  • Branding

  • Designs

  • Images

  • Text

  • Digital products

  • Downloadable materials

are owned by Lakestone or its licensors and are protected by Canadian and international intellectual property laws.

No rights are granted except as expressly stated herein.

11. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Services and all products are provided “as is” and “as available.”

Lakestone disclaims all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

Lakestone does not warrant that the Services will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by applicable law:

Lakestone shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the Services.

Lakestone’s total aggregate liability shall not exceed the amount paid by you for the product giving rise to the claim.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

13. Indemnification

You agree to indemnify and hold harmless Lakestone and its officers, directors, employees, affiliates, and service providers from any claims, damages, liabilities, or expenses arising from:

  • Your breach of these Terms;

  • Your misuse of the Services;

  • Your violation of applicable laws.

14. Force majeure

Lakestone shall not be liable for delays or failure to perform resulting from events beyond its reasonable control, including but not limited to natural disasters, supply chain disruptions, government actions, or technical failures.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Manitoba and the applicable federal laws of Canada.

You agree that any disputes shall be brought exclusively before the courts located in Manitoba, Canada.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Changes to terms

Lakestone reserves the right to modify these Terms at any time.

Updated Terms will be posted with a revised “Last updated” date.

Continued use of the Services constitutes acceptance of the revised Terms.
